Quick answer

A height analysis is tested at four points: the provenance of the scale reference, the continuity of the camera between the recording and the analysis, the condition of the scene at the time of measurement, and whether the reported conclusion stays inside the uncertainty the method can support. A report that measured its own reference, used the original camera in an unaltered scene, documented frame selection, and reported an interval is a strong report. Reports missing any of those elements have identifiable, reviewable gaps.

The review framework

We work through an opposing analysis in a fixed order, because early failures make later questions moot.

Step 1

Evidence integrity. Compare the analyzed file against the original recorder export. Determine whether the examiner worked from a transcoded or rescaled copy.

Step 2

Scale provenance. Identify what established the scale, whether it was physically measured, and whether that measurement is documented with photographs.

Step 3

Camera continuity. Establish whether the camera, lens, and configuration at the scene visit matched those at the time of recording, and whether that was verified or assumed.

Step 4

Scene condition. Determine whether the location had changed, and whether any change affected the floor plane or the subject position.

Step 5

Position fidelity. Assess how the subject position was located and how much positional error is plausible.

Step 6

Frame analysis. Review the selected frames for posture, stride phase, obstruction, and distance from the frame center, and look for excluded frames that would widen the result.

Step 7

Uncertainty and scope. Evaluate whether the interval reflects the identified error sources and whether the conclusion exceeds them.

When the analysis is sound

A review sometimes confirms that an opposing analysis is well executed. That answer is worth having early, because it lets counsel redirect effort toward the interval itself, toward footwear and posture, or toward the fact that the interval encompasses a very large population.

What to request in discovery

The report alone rarely permits a meaningful review. The underlying materials are where the analysis is either confirmed or undone.

  • The original recording as exported from the recorder, with hash values, not the examiner working copy.
  • All scene visit imagery, including photographs of the calibrated reference in place and imagery recorded through the camera.
  • Measurement records for the reference object itself, showing it was measured rather than assumed.
  • Camera documentation: make, model, lens, mount, configured resolution and field of view, and any evidence of replacement or re-aiming.
  • Working notes and measurement data, including every frame examined, not only those cited.
  • Software output and version information where photogrammetric software was used.
  • Any 3D scan data and the parameters used for camera matching.
  • The examiner file for prior versions of the report and communications about the requested conclusion.

Requesting these items by name, rather than asking generally for the expert materials, produces a far more useful production and creates a clear record if items are missing.

These questions are effective because they are fair. Each one goes to a documented element of the analysis rather than to the credibility of photogrammetry generally, which is well established and not a productive target.

The reference

Did you measure the object you used to establish scale, or did you rely on its specified dimensions? Where is that measurement recorded?

The camera

Is the camera you used for comparison imagery the same physical unit that made the recording? How did you confirm the settings were unchanged?

The position

How did you determine the exact spot where the subject stood? How much error is possible in that placement, and is it in your interval?

The frames

How many frames met your selection criteria, and why did you use these? What would the result be using the others?

The shoes

What footwear did the subject wear, and how did you account for sole and heel thickness in your reported figure?

The scope

Does your measurement identify a specific person, or does it describe a range that includes a very large number of people?

Where the underlying analysis is strong, these questions establish the interval honestly and let counsel argue from the interval rather than against the science.

What matters most

  • Underlying materials. The report is a summary, the working file is the evidence.
  • Measured versus assumed. Every assumed dimension is a reviewable gap.
  • Continuity. Camera and scene changes are frequently undocumented and frequently decisive.
  • Interval integrity. An unstated or unsupported interval is the most common defect.
  • Scope. The line between consistency and identification is where most overreach occurs.

Common misconceptions

You have to attack photogrammetry itself

Photogrammetric measurement is well established. Effective challenges target application, documentation, and the scope of the conclusion.

The report tells you everything

Frame selection, rejected measurements, and reference provenance frequently appear only in the working notes.

A consistent result means a correct result

Systematic error produces consistent results that are consistently wrong.

A rebuttal expert must give a competing number

Often the correct rebuttal opinion is that the available evidence does not support any reportable measurement.

When this applies, and when it does not

This applies when

  • The prosecution has disclosed a height analysis or intends to.
  • A civil opponent relies on photogrammetric measurement for identification.
  • The reported figure is close to your client documented stature.
  • The underlying materials have not been produced.

This does not apply when

  • No measurement evidence exists or is contemplated in the case.
  • The height issue is not material to any contested fact.
  • The recording itself is inadmissible for independent reasons.
  • The candidate heights differ so widely that no interval could be dispositive.

How do you challenge a height analysis?

By testing its application rather than the discipline. The productive questions are whether the scale reference was actually measured, whether the camera and scene were the same as at the time of recording, how the subject position was located, why the specific frames were used, and whether the reported conclusion stays within the uncertainty the method supports.

What should I request in discovery?

The original recorder export with hashes, all scene visit imagery, the measurement records for the reference object, camera make model and configuration, complete working notes including rejected frames, software versions and output, and any 3D scan data with the camera matching parameters used.

Is it worth retaining a rebuttal expert if the analysis looks sound?

Usually yes, because the review often reframes the issue. Even a well executed analysis produces an interval that includes a large population, and establishing that clearly is frequently more valuable than disputing the measurement.

What if the scene has changed since the offense?

That is a significant issue. Reverse projection depends on reproducing the original geometry. If the floor, fixtures, or camera position changed before the analysis, the examiner had to compensate, and the report should state exactly how and how much uncertainty that added.

Can a rebuttal expert simply say the measurement is unreliable?

Only where the materials support that. A credible rebuttal identifies specific defects and explains their effect. Where the evidence cannot support any measurement, saying so plainly is itself a legitimate and defensible opinion.

How quickly should a review be started?

Immediately after disclosure. If independent reproduction at the scene is going to be possible, that window closes as the location and its camera equipment change over time.
