These cases are decided by seconds. Vehicle modules, infotainment systems and phone artifacts each hold part of the record, and each keeps time differently.
In a vehicular homicide or DUI case the decisive evidence is timing measured in seconds across three independent systems: the vehicle event data recorder, the infotainment or telematics module, and the phone. Each system uses its own clock and its own sampling method. Independent review extracts all three, establishes the offset between their clocks, and determines what the data actually shows about speed, braking, phone interaction and driver attention in the seconds before the event.
The common allegation is that the driver was using a phone at the moment of impact. The support for that allegation is usually a phone extraction showing an event near the time of the crash. What the extraction rarely shows is whether the event required user interaction, whether the screen was on, whether the phone was in the driver's hand or in a passenger's, and whether the timestamps in the two systems refer to the same instant.
Modern phones generate constant background activity: message delivery, application refresh, location updates, notification arrival and sync operations. All of these produce timestamped records that look identical to user activity in a summary. Meanwhile the vehicle module records its own pre event window in its own clock, and the two clocks are frequently offset by seconds or minutes. Comparing them without establishing the offset produces conclusions with no basis.
Independent review extracts the vehicle modules and the phone, distinguishes user interaction from background writes, establishes the clock offset between systems against a reference, and states what the combined record supports about driver behavior in the seconds before the event.

Four unanswered questions sit between this exhibit and a distraction conclusion, and each one is answerable.

A notification arriving is not a driver interacting. Screen state and foreground application settle the question.

After offsets are applied, the phone event moves to after the impact, which removes the distraction theory entirely.
Sources that answer the interaction question directly carry the most weight in a distraction analysis.
We review the imaging method, module identification, validation status and the reported parameters, then interpret them within the documented accuracy limits. Reported values are module outputs, not measurements, and their limitations are part of any honest opinion.
Head units and manufacturer cloud services retain paired devices, call activity, navigation, door and ignition events and trip records. These sources are independent of both the phone and the crash module, and they are frequently never collected.
Every phone artifact near the event window is classified as user interaction or background write, using screen state, foreground application, unlock and notification artifacts. Most distraction allegations dissolve at this step or become substantially weaker.
We establish the offset between the vehicle module, the head unit, the phone and any external reference such as a 911 record. Without measured offsets, a second by second comparison between systems is not supportable.
Data showing which device was paired, which seat a device was associated with, whether hands free was active and whether biometric interaction occurred all speak to who was operating the vehicle and whether a phone was handheld.
Imaging documentation, hash verification, module and tool identification, validation references, time zone declarations and the traceability of conclusions to underlying data are documented and tested.
The same records, once synchronized and classified, support the opposite of the state's summary.

A timestamped record near the crash time is commonly a background sync, a message delivery or a location update, none of which involve a person touching the phone. The classification step decides the issue.
Reported speed is a module output derived from sensor inputs and subject to documented accuracy limits that vary by manufacturer and system. Those limits are part of the opinion. Presenting a reported value as a precise measurement without stating the tolerance and validation status is not defensible.
Head units retain paired device identifiers, call histories, contact transfers, navigation destinations and door and ignition events. That record can establish which phone was connected, whether a call was hands free, when the vehicle was started and where it was directed, independent of both the crash module and the phone.
Because these cases are argued in seconds. If the vehicle module clock is thirty seconds ahead of the phone clock and no one measured the difference, an event that occurred after the impact can be presented as occurring before it. Establishing the offset against a reference is a prerequisite to any comparison.
Sometimes, using device pairing records, seat associated systems, biometric unlock artifacts, motion data and occupant related module entries. It is a probabilistic analysis stated with its limitations, and in contested driver cases it is frequently the most valuable part of the examination.
Immediately. Vehicles are repaired, salvaged or crushed, modules are overwritten by subsequent ignition cycles in some systems, and telematics records have retention limits. Early preservation is the difference between having the data and arguing about its absence.
