When a business is compromised, the legal question is narrow: what data was accessed or taken, and when. This guide explains how examiners answer that question with evidence rather than assumption.

Quick answer. Digital forensic experts in data breach investigations establish how an intruder gained access, how long they were present, which systems and accounts were touched, and whether data was actually removed. That work relies on endpoint telemetry, Windows and Linux system logs, cloud sign in and audit logs, email system records, and network data. The resulting written findings are what a company uses to make notification decisions, respond to regulators, and support an insurance claim.
| Question | Short answer |
|---|---|
| What is the first step? | Preserve logs and system images before remediation destroys them. |
| Can you prove data was taken? | Sometimes definitively, sometimes only as a supported likelihood, depending on available logs. |
| How long does an investigation take? | Initial scope in days; full analysis and reporting usually in weeks. |
| Do we have to notify? | That is counsel decision, informed by the forensic findings. |
| Should we rebuild the servers first? | Not before preservation. Rebuilding routinely destroys the proof of scope. |
| Does insurance cover this? | Often yes, and carriers generally expect documented independent findings. |
Breach investigations get expensive when they lose focus. Four questions drive the legal and regulatory consequences.
Initial access is normally identified from authentication logs, email records, exposed remote access services, or vulnerable public facing applications. It matters both for closing the gap and for demonstrating due diligence.
Dwell time frames the entire scope. A one hour intrusion and a four month intrusion have very different notification and exposure implications.
Account use, process execution, file access, and system to system connections define the affected footprint. This is where endpoint telemetry and cloud audit logs carry the most weight.
This is the question most often answered badly. Access to a file share is not the same as removal of its contents. Honest findings distinguish confirmed exfiltration, evidence consistent with exfiltration, and an absence of evidence either way.
The instinct after discovering an intrusion is to rebuild and move on. That instinct destroys the record needed to determine scope, and it frequently converts a defensible position into an indefensible one.
Endpoint telemetry, cloud sign in logs, and email audit records are commonly retained for only thirty to ninety days, and shorter in some configurations. Reimaging a compromised server without capturing an image first removes the primary evidence permanently. Preservation can be completed quickly and in parallel with containment.
Notification obligations arise under state breach statutes and, depending on the industry, sector specific rules. Counsel makes that determination, but the determination is only as good as the forensic record behind it.
Insurers generally expect an independent investigation with documented methodology. Reporting that states what is confirmed, what is supported, and what remains unknown withstands scrutiny far better than a conclusion that outruns the evidence.
Log retention windows are short. Call before servers are rebuilt or endpoints are reimaged.
Request Confidential Consultation| Evidence source | What it establishes | Typical retention |
|---|---|---|
| Endpoint telemetry | Process execution, network connections, file activity | Thirty to ninety days |
| Cloud sign in and audit logs | Account access, location, method, administrative changes | Thirty to ninety days by default |
| Email system audit records | Mailbox access, rule creation, forwarding, message movement | Varies by license tier |
| Windows and Linux system logs | Authentication, service activity, execution | Days to weeks by default |
| Firewall and network records | Volume and destination of outbound traffic | Often days |
| Forensic system images | Full state of a compromised machine at collection | Permanent once captured |
A forensic investigation is appropriate for ransomware, business email compromise, unauthorized administrative access, suspected insider exfiltration, vendor compromise, or any intrusion with notification, contractual, or insurance implications.
It is usually unnecessary for a blocked phishing attempt with no successful authentication, or an isolated malware detection that endpoint tooling quarantined with no follow on activity.
We investigate business intrusions independently, working with counsel and insurers, and we preserve evidence before remediation removes it. Our reports separate confirmed findings from supported inferences and state plainly where the available logs cannot answer a question.
All work is performed under a written engagement letter with a conflicts check, verified hashing, and documented chain of custody. Reports are internally reviewed before release, and our examiners have been qualified to testify in state and federal courts. Related reading: digital forensic experts in every case type.
Engagements normally begin within one business day of a signed engagement letter and funded retainer. Expedited scheduling is available when a hearing, production deadline, or notification clock is close, with rush terms confirmed in writing first.
Elite Digital Forensics is an independent digital forensic firm serving attorneys, businesses, and individuals in all fifty states. Our examiners include court qualified expert witnesses, former law enforcement forensic examiners, and certified digital forensic analysts. We accept matters from criminal defense counsel, civil litigators, in house counsel, and individuals, and we run a conflicts check at every intake. Engagements are documented from the first call: written scope, written chain of custody, verified forensic images, and reports written for attorney review, negotiation, or court.

Preserve evidence. Endpoint telemetry, cloud audit logs, email records, and system images are captured before containment and rebuilding destroy them, because those records are what establish scope.
Sometimes definitively, when outbound transfers or archive creation are recorded. Otherwise findings are stated as supported likelihood or as unknown. Available log retention is usually the deciding factor.
Immediately. Many of the most valuable records exist for only thirty to ninety days, and some for only days.
Generally yes. Carriers typically expect an independent investigation with documented methodology and clear findings.
Yes. Containment and preservation run in parallel. What must be avoided is reimaging or rebuilding before evidence is captured.
That is a legal determination for counsel under the applicable statutes. Our role is to supply the factual record on which the determination rests.
